Terms of Service

Draft pending legal review. These terms will be replaced by a reviewed version before paid service begins.

These terms govern access to and use of Talos, a hosted booking and operations service operated by HD Marketing, LLC (“we”, “us”). By using Talos you agree to them. If you use Talos on behalf of a company, you agree for that company.

The service

Talos lets rental companies (“Operators”) manage inventory, take bookings and run jobs. Features may change as the service develops. During the pilot and demo period the service is provided for evaluation and may be changed, interrupted or reset.

Subscriptions

Paid use of Talos by an Operator is governed by a separate written subscription agreement. If that agreement conflicts with these terms, the subscription agreement controls.

Accounts

• Keep login credentials confidential and accurate.
• Operators are responsible for the staff they give access to and for activity under their accounts.
• Tell us promptly about any unauthorized use.

Acceptable use

You may not:

• Use Talos for unlawful rentals, materials or activity.
• Send spam or messages customers have not agreed to receive.
• Attempt to access another company’s data, probe or disrupt the service, or bypass its security.
• Resell, copy or reverse engineer the service.

Your data

Operators own their business data, including catalogs, pricing, branding and customer records. We use it only to provide and support the service, as described in our Privacy Policy. Operators are responsible for having the right to collect and use their customers’ information.

Rental agreements

Each rental is a contract between the Operator and its customer. The Operator sets its own rental terms, including weight limits, prohibited materials, fees and liability. We are not a party to those rentals.

Our property

Talos, including its software, design and documentation, is owned by HD Marketing, LLC and protected by law. Using the service grants no ownership rights.

Disclaimers and liability

The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, or for lost profits or data, and our total liability is limited to the amount paid for the service in the twelve months before the claim, except as a subscription agreement provides otherwise.

Suspension and termination

We may suspend access that violates these terms or threatens the security of the service. Operators may stop using Talos at any time and may request an export of their data.

Changes

We may update these terms. The date at the top shows the latest version; continued use after an update means you accept it.
